Why is there no separate DA or VDA line?

Haryana publishes a single basic rate rather than splitting the wage into basic plus dearness allowance. The notification is explicit that these rates cannot be broken into components in the form of allowances by the employer.

Inflation is handled differently here. The notification provides for 100 per cent neutralisation of any rise or fall in the consumer price index on a pro rata basis, with the adjustment made as prescribed in the Code on Wages Rules, 2026.

Question 2

Which employments does this cover?

Accepted Answer

All of them. Unlike states that publish a numbered list of scheduled employments, Haryana applies these rates across every employment in the state.

The notification names establishments under section 2(m), factories under section 2(n), employees under section 2(k), workers under section 2(z) and contract labour under section 2(g) of the Code on Wages, 2019. Brick kilns are the one carve-out and will be notified separately.

Question 3

Do I divide the monthly wage by 26 days or 30?

Accepted Answer

Both, for different purposes. Per-day wages are calculated by dividing the monthly wage by 26. Deductions, however, are calculated on 30 days, or as the appropriate Government prescribes from time to time.

Using one divisor for both is a frequent payroll error and it works against the employee, so it is worth checking how your system is configured.

What do trainees and apprentices get paid?

A trainee is paid 75 per cent of the rate for their category, but never less than the unskilled minimum, on the reasoning that unskilled work requires no training in the first place. Training cannot run longer than one year.

Apprentices are different. Anyone engaged under the Apprentices Act, 1961 is governed by that Act rather than by these rates.

Are contractor and agency workers covered?

Yes, and the liability sits with you. Where workers are engaged through a contractor or service provider, the notification makes the occupier or principal employer personally responsible for ensuring the contractor actually pays the minimum rates.

A clause in your vendor contract does not transfer that responsibility. Ask for wage registers, not assurances.

Question 6

Can we pay two people in the same category differently?

Accepted Answer

Not below the floor. The notification states that no worker may be paid less than the minimum fixed for a similar category with the same skills and experience, and that there shall be no difference between the wages of men and women workers.

Paying above the minimum for performance or seniority is unaffected.

Is this issued under the Minimum Wages Act?

Accepted Answer

No. This notification is made under Section 8(3) of the Code on Wages, 2019, which has subsumed the Minimum Wages Act, 1948. It supersedes the Haryana rates last revised in October 2015.

The wider effect of the Code matters beyond this table. Its definition of wages, with the 50 per cent floor, changes how provident fund, gratuity and bonus are computed even where the minimum wage figure itself does not move.
